TransCanada received approval from the National Energy Board (NEB) on July 7, 2005 for a new Code of Conduct for the Canadian Mainline System, effective October 6, 2005. This new Mainline Code establishes a comprehensive framework of standards and conditions for interactions between TransCanada, in its ownership and operation of the Canadian Mainline, and affiliated companies.
This new Mainline Code is based on the recently-approved NGTL Code of Conduct for the Alberta System, which was published in the February 2005 issue of the Update magazine. Modifications were made to the NGTL Code to reflect, among other things, the different corporate and regulatory circumstances for each System. However, the underlying principles in each of the Codes are the same.
Specifically, the Mainline Code establishes rules to ensure TransCanada and its representatives, in conducting Mainline System business, adhere to the following:
- Work, interact, and share information appropriately with other TransCanada employees and affiliated businesses
- Protect confidential customer information collected by TransCanada in the course of providing Mainline System services
- Ensure the Mainline System does not cross-subsidize affiliates' activities
- Ensure affiliates and their customers do not have preferential access to Mainline System services
- Avoid uncompetitive practices between TransCanada and its affiliates, which may be detrimental to the interests of Mainline System customers
TransCanada has operated under previous codes and some of our subsidiaries in the United States now operate under the affiliate transaction requirements established by the Federal Energy Regulatory Commission (FERC) in its recent FERC Order 2004.
